Welcome to WelcomeHub! These Terms of Service (“Terms”) govern your use of our online form and PDF builder platform (the “Service”). By using our Service, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you should not use our Service.

2. Eligibility

4. Use of the Service

WelcomeHub provides users with the ability to create, customize, and submit branded PDFs through online forms. You agree to use the Service only for lawful purposes and in accordance with these Terms. You are prohibited from:

• Using the Service in any way that could damage, disable, overburden, or impair the functionality of the platform.
• Uploading or distributing content that infringes upon the rights of others, including intellectual property rights.
• Attempting to gain unauthorized access to any part of the Service or related systems or networks.
• Using the Service for illegal, fraudulent, or malicious activities.

5. Payment and Fees

Some features of the Service may require payment. By using these features, you agree to pay all applicable fees for the services you choose. All payments are processed through a third-party payment processor. You agree to provide accurate payment information and to comply with the payment terms of our third-party providers.

We reserve the right to modify our pricing and billing practices at any time. You will be notified of any changes, and you may choose to discontinue the use of paid features if you do not accept the changes.

6. Intellectual Property

The Service and all content, features, and functionality (including but not limited to text, graphics, logos, images, software, and data) are the exclusive property of WelcomeHub or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any part of the Service without our express written consent, except as permitted by these Terms.

7. Data Ownership and Usage

You retain ownership of the data you upload and submit through the Service, including any form responses and customized PDFs. However, by using the Service, you grant WelcomeHub a limited, non-exclusive, and royalty-free license to use, process, and store your data for the purpose of providing the Service.

We will not share, sell, or rent your data to third parties, as outlined in our Privacy Policy. You can manage and delete your data at any time in accordance with the policy.

8. Data Retention and Account Deletion

We retain data for up to 3 months at your request or until you delete your account. You may delete your account and associated data at any time by contacting us at support@welcomehub.ai. Once deleted, your data will be permanently removed from our system, and you will no longer have access to your account or any associated forms.

9. Third-Party Services

We may use third-party providers to facilitate certain aspects of the Service, including payment processors and cloud storage providers. By using the Service, you acknowledge and consent to the involvement of these third parties in the operation of the Service. 10. Disclaimers and Limitation of Liability

WelcomeHub provides the Service “as is” and makes no representations or warranties, express or implied, regarding the accuracy, reliability, or availability of the Service. We do not guarantee that the Service will be error-free, uninterrupted, or secure.

To the fullest extent permitted by law, WelcomeHub is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless WelcomeHub, its affiliates, employees, and partners from any claims, losses, liabilities, or expenses (including attorneys’ fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion if we believe you have violated these Terms. Upon termination, your right to access the Service will immediately end, and any outstanding payments will become due.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Salt Lake City, Utah. Any disputes arising from these Terms will be resolved in the courts located in Salt Lake City, Utah.
